Contest open only to residents of CT, DC, DE, FL, GA, IN, MA, ME, MD, MN, MO, NC, NH, NJ, NY, OH, PA, RI, SC, TN, TX, WA, WV, WI, VA and VT who are 21 years of age or older. Void in IL, KY, MI, CA and where otherwise prohibited by law.
CONTEST: Submit the best photo of a beer dinner featuring Magic Hat products along with the recipe (AND ANECDOTE) and win the grand prize. Magic Hat staff will choose the winner from among all eligible entries. All photos will be posted on www.magichat.net/FOF. Members of the www.magichat.net website (must be 21 years of age or older to join) may post comments. Other restrictions apply. By entering the context, you agree to be bound by these Official Rules.
SPONSOR: This Contest is sponsored by Magic Hat Brewing Company (“Sponsor”), 5 Bartlett Bay Road, South Burlington, Vermont 05403. www.magichat.net
GRAND PRIZE: The Winner will receive a $500 gift certificate to the supermarket of the Winner’s choosing. ARV of Grand Prize: $500. The prize will be awarded. Odds of winning the Prize depends on the number of eligible entries received.
HOW TO ENTER: The contest begins October 1, 2009 and ends 11:59 pm ET December 31, 2009. All entries must be received by 11:59 pm ET on December 31, 2009. Send us your best photo of a beer dinner featuring Magic Hat products along with the recipe and anecdote. Your photo must be submitted as a jpeg and the recipe MUST BE IN FORM ON THE CONTEST SITE.
TO ENTER: Go to www.magichat.net/FOF, fill out the on-line entry form as posted on the website including all required fields, attach your photo Fill in form with recipe, and submit in accordance with the on-line instructions. Entries may only be submitted online at www.magichat.net/FOF. No other forms of entry are acceptable. One entry per e-mail or other address, so choose your best work!
Entries must be received on or before 11:59 pm ET December 31, 2009 and must meet all eligibility requirements. The winner will be required to sign an Affidavit of Eligibility and a Release.
RIGHTS IN SUBMISSIONS: IF YOU DO NOT WANT US TO OWN YOUR PHOTO AND RECIPE, OR YOU DO NOT WANT YOUR NAME USED FOR OUR PUBLICITY, WE RESPECT THAT, BUT DO NOT ENTER THE CONTEST!
All entries become the sole and exclusive property of Magic Hat Brewing Company on submission and may be used, displayed, reproduced, modified and distributed by us throughout the world in any media forever without further permission from or compensation to you. We may use your submission or we may not. We may use it now, or we may use it later. We may use it even if it does not win!!! Entries will not be returned.
By entering the Contest, you forever assign us and our successors and assigns all rights and title in the entry and all aspects of the entry including but not limited to the design submission. This means we own and control the design forever in every media throughout the world.
By entering the contest, you confirm warrant that your entry was created exclusively by you, and does not contain images, text, graphics, photos or any other elements belonging to or created by a third party, any libelous or obscene material or any material that violates the trademark, copyright, patent, publicity, privacy or other rights of anyone else. You warrant that your design has not been produced or sold commercially before.
You may use reproductions of Magic Hat trademarks, labels, text and graphics in your work, but only in connection with your entry in this Contest, and for no other purpose. All rights in our name and marks not expressly granted here are reserved to us.
By entering the Contest, you grant us permission to use your name and likeness on our website and any other promotional materials in any media forever without further compensation, unless prohibited by law.
ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. Prizes are not transferable before award. No prize or cash substitutes allowed (although Magic Hat may award a prize of like value to the winner in the event the grand prize is unavailable).
WHAT WE ARE LOOKING FOR:
1. Your entry must feature a Magic Hat product in the recipe. Your entry should breathe of Magic Hat Brewing Company. The use of magicians, hats, rabbits or wands will disqualify you.
2. Your photo entry must be in jpeg format. Your recipe and anecdote must be filled into the form on the contest website. Anecdote should be tied to your picture: either about the dish itself, the recipe and how it fits the Magic Hat product it is used with and or perhaps a story about the dinner party where it was served. One photo and recipe submission per entrant.
3. All photo entries will be posted on our website. Members of the www.magichat.net
website (must be 21 years of age or older to join) may post comments. We will choose one (1) Winner from all eligible entries.
4. JUDGING: The creative Staff at Magic Hat will select the winner from all eligible entries. The decision of the Staff is final and in our sole (and totally subjective) discretion of how creative, imaginative and appropriate for our Feast of Fools Photo Contest. All photos will be posted on our website. Anyone 21 years of age or older may view the photos on our website. Members of the www.magichat.net website (must be 21 years of age or older to join) may post comments.
OTHER GENERAL CONDITIONS:

Maryland retailers, directors, officers and employees of the Sponsor and any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies and immediate families of each are not eligible to win the Prize.
RELEASE AND DISCLAIMER. All entrants agree to hold harmless and release Sponsor, its affiliates, parent, subsidiaries, shareholders, directors, officers, employees, the service agencies and independent contractors of any of the above and all others associated with the development and execution of this Contest from any and all liability with respect to or in any way arising from this Contest; participation in any Contest-related activity; and/or delivery/misdelivery, acceptance, possession, use, or misuse of a prize, including, but not limited to, liability for breach of any intellectual property or proprietary rights, personal injury, bodily injury (including wrongful death or disability), damage to property, and damage or loss of any other kind. Neither the Sponsor nor its agents are responsible for lost, late, misdirected, unintelligible, returned or undelivered prize claims, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network. Persons who tamper with or abuse any aspect of this Contest or website, or act in violation of the Official Rules, or act in any manner to threaten or abuse or harass any person, or violate website's terms of service, as solely determined by the Sponsor, will be disqualified. Sponsor is not responsible for any incorrect or inaccurate information whether caused by website users, tampering, hacking, or by any of the programming or equipment associated with or used in this Contest, and assumes no responsibility for any errors, omission, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized website access. Any use of robotic, macro, automatic, programmed or like Contest plays or entry methods will void all such plays/entries, and may subject that entrant to disqualification. Sponsor is not responsible for injury or damage to participants' or any other person's computer or property related to or resulting from participating in this Contest. Should any portion of this Contest, in the Sponsor's sole opinion, be compromised by virus, worms, bugs, unauthorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair administration, security, fairness or proper administration of this Contest, or submission of entries, Sponsor reserves the right at its sole discretion to cancel, suspend, modify or terminate the Contest, and have its Staff select the winner from eligible entries received prior to action taken, or otherwise as may be deemed fair and equitable by the Sponsor.
Only the number of prizes stated in these Official Rules will be awarded. In the event of a dispute regarding entries received from multiple users having the same email account, the authorized subscriber of the email account used to play/enter will be deemed to be the participant, and must comply with these rules. The authorized account subscriber is the natural person who is assigned the email address by the ISP or other organization responsible for assigning email addresses
PUBLICITY RELEASE: Use of Entrant’s names, likeness and information. Each entry constitutes the Entrant’s grant and assignment to Sponsor forever in any media worldwide of an unconditional right to use Entrant’s name, address (city and state only), voice, likeness, photograph, biographical and prize information and/or statements about the promotion for any Sponsor publicity, advertising and promotional purposes without additional review, compensation, permission or approval of the winner, except where prohibited by law. An “Entrant” is a person who submits a contest entry and/or votes in the Contest.
CONDITIONS OF ENTRY. Entrant agrees that as a condition of entering the Contest: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the state and federal courts of the State of Washington; (ii) by participating or submitting an entry in the Contest, entrant consents to the personal and subject matter jurisdiction of such courts for such purpose; (iii) the parties waive any right to trial by jury; (iv) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by entrant, including costs associated with entering this Contest but in no event entrant's attorneys' fees; and (v) under no circumstances will entrant be permitted to obtain an award for and entrant hereby expressly waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and further waives any and all rights to have damages multiplied or otherwise increased. THIS GAME IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF WASHINGTON, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES.
ALL PRIZES ARE AWARDED “AS-IS” WITHOUT WARRANTY OF ANY KIND. ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXCLUDED. WINNER ACCEPTS PRIZES “AS-IS.” SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

• Contest not open to the employees, immediate family, or household members of Magic Hat Brewing Company, its parent or affiliated companies or any of its wholesalers, distributors, vendors, or any of their immediate families and household members.

• Entrants must include all required fields on the on-line entry form.
• Entrant’s photo must be submitted as a jpeg and recipe and anecdote must be filled in form on website contest page.
• Entrants may be required to sign an Affidavit of Eligibility and Release unless prohibited by law.
• Any entrant failing to meet any terms or conditions of this Contest will be disqualified.
